Empatha AI (“we,” “our,” “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal data when you use the Empatha AI Service (the “Service”) and outlines your privacy rights. By using our Service, you agree to the collection and use of your data as described in this policy.

    Account: A unique account created for you to access our Service.

Personal Data: Any information that relates to an identified or identifiable individual.

User Content: Screenshots, images, and text you upload for analysis.

Usage Data: Data collected automatically, such as IP address, browser type, and diagnostic data.

    Types of Data Collected:

Personal Data: We may ask for your name, email address, and phone number to manage your account.

User Content (Screenshots/Media): With your permission, we collect screenshots of messaging conversations. We use Optical Character Recognition (OCR) to extract text from these images for analysis.

Usage Data: Automatically collected data including device identifiers, pages visited, and interaction patterns.

How We Use Your Data:

To provide the Service: Including generating "Analysis Output" via our AI pipeline.

To manage your account: Providing customer support and sending service updates.

To analyze usage patterns: Improving user experience and app performance.

To comply with legal obligations.

  1. AI Processing & Training
    Provider Identification: To provide the Service, we share extracted User Content (text) with our third-party AI provider, OpenAI.

    Data Minimization: We only transmit the text extracted from your screenshots. We do not share your Personal Data (name, email, or phone number) with OpenAI. Original screenshot files are deleted from our active storage immediately after text extraction and are not shared with third parties.

    No Training: In accordance with our enterprise agreements, your data is used solely to generate analysis for you and is not used by OpenAI to train their Large Language Models (LLMs).

Training Opt-In: We do not use your personal conversation screenshots or extracted text to train our AI models unless you provide explicit, informed consent via in-app settings. You may withdraw this consent at any time.

  1. Data Retention and Security
    Retention: We retain Personal Data only as long as necessary for the purposes outlined in this policy.

Screenshot Deletion: To protect your privacy, we aim to delete raw screenshot files from our active storage immediately after successful OCR text extraction is complete.

Security: We implement commercially reasonable security measures, including encryption of data at rest and in transit. However, no method of electronic storage is 100% secure.

    We do not sell your personal data. We may share data with:

Service Providers: Trusted third parties who assist in hosting, analytics, and AI-powered text processing. We confirm that any third-party AI service provider we engage (e.g., OpenAI) provides data protection standards that are equal to or greater than the protections outlined in this Privacy Policy.

Business Transactions: In the event of a merger or sale of assets.

Legal Requirements: If required by law or to protect our rights.

    Revoking AI Consent: You may withdraw your consent for third-party AI processing at any time through the in-app Settings menu. Please note that since AI analysis is a core feature of the Service, revoking consent will disable the analysis functionality of the App.

Access/Rectification: Request a copy of or corrections to your data.

Deletion: Request the removal of your Personal Data.

Withdraw Consent: Rescind permission for data processing at any time.

    Our Service is not directed to individuals under the age of 18 (as per our TOS). We do not knowingly collect data from children under 13. If we discover such data has been collected, we will delete it immediately.
